So why in arguing Shelby County v. Holder, which gutted the Voting Rights Act, didn’t the federal government cite The Guarantee Clause in addition to the 14th Amendment? Obviously, SCOTUS got it wrong. Sometimes, years later in passing, one of the Justices will note “you should have argued this, not that” as an excuse for an unpopular or incorrect decision. Seems like the wheel has to be reinvented now.
